The advertised property price is not always the complete acquisition cost. Buyers should identify taxes, registration expenses, association charges, financing costs and developer-specific fees before comparing options.

Start with the transaction type

Taxes differ depending on whether the property is a capital asset or an ordinary asset, who the seller is, and how the transaction is structured. A resale between individuals is not taxed in exactly the same way as a developer sale.

Taxes you may encounter

The Bureau of Internal Revenue identifies capital gains tax, creditable withholding tax and documentary stamp tax among the tax categories relevant to transfers of Philippine real property. BIR Revenue Regulations No. 7-2003 states that a sale of real property classified as a capital asset by an individual is generally subject to a 6% capital gains tax based on the gross selling price or current fair market value, whichever is higher; ordinary-asset sales follow a different tax treatment.
